Please read before purchasing. By accessing this website, purchasing a service or Hosting & Care plan, scheduling onboarding, or using a delivered app, you agree to these Terms & Conditions. All one-time app-build and website-build sales are final and non-refundable.

1. About These Terms

These Terms & Conditions govern services provided by Next for Success LLC, doing business as The Frugal Techie Business Coach (“we,” “us,” or “our”), including Interactive Lead Magnet Lady app builds, websites, landing pages, strategy, integrations, Hosting & Care, updates and related services.

2. Services and Scope

Your purchase includes only the features, deliverables, revisions and support identified in the selected package, checkout description, written proposal or other written scope. Examples, demonstrations and portfolio projects illustrate possibilities but do not expand your purchased scope.

New questions, scoring or recommendation logic, user accounts, databases, dashboards, advanced storage, additional integrations and other substantial features are not routine revisions. They may require a separately quoted App Expansion project and adjusted hosting.

Website and landing-page projects may include a small linked design credit in the footer identifying The Interactive Lead Magnet Lady as the creator. The credit will link to our current service website and may be updated if that website address changes. Removal or alteration of the credit must be agreed in writing.

3. Client Responsibilities

You agree to provide accurate, complete and timely copy, branding, images, questions, logic, legal disclosures, platform access and feedback reasonably required for your project. You are responsible for reviewing and approving all wording, calculations, recommendations, links and functionality before launch.

Delays in supplying materials, attending calls, providing access or responding to drafts may extend delivery dates. Any stated delivery target begins only after required onboarding, materials, access and strategy calls are complete.

4. Drafts, Revisions and Approval

Your first working draft is targeted within the timeframe stated in your package after the onboarding requirements are complete. Timelines are estimates unless expressly guaranteed in a signed agreement.

Unless a separate written scope states otherwise, the Starter package includes one revision round, the Growth package includes two revision rounds, and Custom projects include the number of revision rounds stated in the written proposal. Each revision round means one consolidated list of requested changes submitted together.

A revision refines the approved build and may include reasonable wording, image, link, color, layout or minor question-and-result adjustments within the agreed scope. A revision does not include a new direction, audience or format; major replacement copy or content; additional questions, outcomes or paths beyond the package; changed scoring or recommendation logic; new integrations; or new functionality. Those requests are rework or expanded scope and may be quoted separately.

After the included revision round or rounds are completed, each project includes one final polish pass for minor finishing touches identified during the final review. The final polish pass is not an additional revision round and does not include new content, logic, features, integrations or a material change in direction.

Genuine technical bugs and corrections to work we completed incorrectly do not consume an included revision round or final polish pass. Client-requested changes based on changed preferences, newly supplied information or a changed business direction are not corrections to our work.

Your approval, publication request, public use or failure to report an issue within a reasonable review period may be treated as acceptance of the deliverable.

5. Pricing, Payments and Final Sales

Prices are listed and charged in U.S. dollars unless otherwise stated. Payment is due according to the checkout page, invoice or written proposal.

All one-time app-build, website-build, landing-page, setup, strategy, integration and update purchases are final and non-refundable. This policy reflects the reservation of project capacity and the customized work that begins after purchase. Hosting & Care cancellation is addressed separately below.

Chargebacks or payment disputes filed without first contacting us may result in immediate suspension of work, hosting and access while the matter is reviewed.

6. Hosting & Care

Every delivered interactive app requires an active Hosting & Care plan unless a separate written agreement states otherwise. Standard Hosting & Care is currently offered at $9 per month or $99 per year and begins when the app is ready to launch.

Hosting & Care includes the standard hosted app address, SSL, basic technical upkeep, platform maintenance, genuine bug fixes and standard lead-storage and delivery backup. It does not include content changes, redesigns, new functionality, advanced integrations or unlimited support.

Apps with unusually high traffic, submission volume, storage or backend usage, or apps requiring authentication, databases or advanced cloud services, may require custom hosting. We will communicate a proposed adjustment before changing the plan.

7. Branded Subdomains

A branded subdomain connection is optional and currently costs $49 as a one-time setup plus a $25 annual custom-domain connection fee. You are responsible for owning and renewing the underlying domain and providing appropriate DNS access. Third-party DNS changes and propagation times are outside our control.

8. Requested Updates and Technical Bugs

Genuine technical bugs in the delivered, approved functionality are covered by active Hosting & Care. A bug does not include changed preferences, revised copy, new content, new links, replacement images, changed business rules, third-party platform changes or newly requested features.

Client-requested updates currently start at $29 and are quoted according to scope. Multiple changes may be grouped into a separate quote.

9. Cancellation, Failed Payments and Suspension

You may cancel Hosting & Care before the next renewal. Your app remains available through the end of the paid billing period and is then taken offline. Amounts already paid for monthly or annual Hosting & Care are non-refundable.

If a recurring payment fails, you will receive a seven-day grace period to update the payment method. If payment is not resolved, the app may be suspended. We currently retain the project for 30 days after suspension to allow reactivation, after which continued retention is not guaranteed.

Source-code transfer, migration to another host and self-hosting assistance are not included in cancellation or in the standard build price.

10. Client Content and Permissions

You retain ownership of the original copy, branding, photographs, trademarks and other materials you supply. You grant us permission to use, reproduce, adapt and host those materials as needed to perform the services.

You represent that you own or have permission to use all supplied materials and that they do not violate another person’s rights. You are responsible for claims resulting from materials or instructions you provide.

11. Deliverables, Platform and Intellectual Property

Upon full payment, you may use the approved finished app or website for your business while all required hosting or platform accounts remain active. Unless a written agreement expressly provides otherwise, the purchase does not include assignment of our underlying development methods, reusable components, templates, source code, prompts, systems or third-party technology.

Apps may depend on third-party platforms and cloud services. Websites or landing pages built inside a client-owned AIOS account remain subject to that platform’s subscription, terms, features and availability.

12. Leads, Data and Compliance

Where included, an app may capture leads and connect to one supported destination. You are responsible for your audience-facing privacy notices, consent language, marketing permissions, email practices, data use and compliance with laws applicable to your business and users.

Backup submissions maintained for delivery recovery are not a client-facing CRM or dashboard. Custom dashboards, direct backup access and advanced data services require a separate written scope.

13. Third-Party Services and Affiliate Relationships

We may recommend or help connect third-party products and services. We do not control their pricing, availability, security, policies, performance or future changes, and your use is governed by their terms.

Some recommendations may use affiliate links. We may earn a commission if you purchase through one of those links, at no additional cost to you. Affiliate compensation does not change your price or guarantee that a third-party service will meet every need.

14. No Guarantee of Business Results

We provide strategy, design, development and technical services. We do not guarantee leads, conversions, revenue, rankings, visibility, deliverability, audience response or any specific business result. Outcomes depend on factors including your offer, traffic, messaging, follow-up, market and use of the deliverable.

15. Availability and Changes

We aim to keep hosted services available, but uninterrupted or error-free operation cannot be guaranteed. Maintenance, security events, internet failures, third-party outages and circumstances beyond reasonable control may affect access.

We may update these Terms as services, pricing or legal requirements change. Changes apply prospectively from the updated effective date unless a different rule is required by law or agreed in writing.

16. Limitation of Liability

To the fullest extent permitted by law, Next for Success LLC and its owners, contractors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost opportunities, lost data or business interruption arising from the website, services, apps or third-party platforms.

To the fullest extent permitted by law, our total liability for a claim will not exceed the amount you paid directly to us for the specific service giving rise to that claim during the six months preceding the event.

17. Indemnification

You agree to indemnify and hold harmless Next for Success LLC, its owner and contractors from third-party claims, damages, liabilities and reasonable costs arising from your supplied materials, unlawful instructions, use of collected leads, violation of these Terms or violation of another party’s rights.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Before filing a formal claim, both parties agree to make a good-faith effort to resolve the dispute through written communication. Unless prohibited by applicable law, courts located in Maryland will have exclusive jurisdiction.

19. General Terms

If a provision is found unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. These Terms, together with the applicable checkout description, proposal and written scope, form the agreement regarding the purchased services. A signed agreement or proposal controls if it expressly conflicts with these website Terms.
